Public Hearing – Road Abandonment

The request was made by property owners on the road because of “excessive vehicles and side by sides riding at night, playing loud music, and throwing out trash.” Commissioners had the option to abandon County Road #546, also known as Go Bar Landing Connector, if they determined it was warranted because it has “ceased to be used by the public to the extent that no substantial public purpose is served by it or its removal from the county road system is otherwise in the best public interest.”

No issues were presented by county staff. No one else spoke in favor or against the request. Commissioners voted to adopt the resolution and abandon the road.

ZONING AGENDA

Lynell G. & Jerry D. Rushing submitted an application to rezone 39.05 acres from HC with Conditions (Highway Commercial with Conditions) and R-40 to a multi-phase development under the Planned Unit Development (PUD) standards. The applicant is specifically requesting a PUD-2 classification. The property is located at 712 Elmer Phillips Road and Georgia Highway 67.

Staff recommended approval of the rezone, though the departmental review noted a negative impact on law enforcement and schools. (A minimum of 250 new students in the Langston Chapel Elementary, Langston Chapel Middle and Statesboro High School Districts)
The Bulloch County Tax Assessor staff estimates a local tax revenue at build-out to be:
County: $277,000
Schools: $171,360
Total Annual Tax Revenue at build-out value: $488,360
No one was present to speak against the application.

Commissioner Walter Gibson made a motion to approve the application, seconded by Commissioner Curt Deal. It was approved unanimously.

Michael J. Mallard submitted an application to rezone 10 acres from R-80 to R-40 to create ten one-acre lots. The property is located at 5861 Clito Road.

Staff report suggested a negative impact on law enforcement and a notation that it is not suitable for the area based on the density.
Applicant was not present.
Mary Jones and Dean Robert were present to speak against the development.

Commissioner Curt Deal motioned to deny the request, which was seconded and denied unanimously.

Josephine Dye submitted an application to rezone 32.8 acres from AG-5 to R-80 to allow for a 10 single family home lots. Homes will resemble Johnson Run. The property is located on Alderman Road.

Commissioners voted unanimously to approve this application with the conditions in the staff report.

JPK Inc. developer of Smith Creek Phase III Subdivision is requesting a county streetlight tax district. Smith Creek Phase III proposes 121 lots at or near 6900 GA Hwy. 46.

River Bluff Properties, LLC developer of the River Bluff Phase III Subdivision is requesting a county streetlight tax district. River Bluff Properties, LLC Phase III proposes 24 lots at or near River Bluff Way.

Cody Rogers, P.E. on behalf of Eagle Creek Construction LLC., developer of Fraser Field Subdivision, is requesting a county streetlight tax district. Eagle Creek Construction proposes 64 lots at or near Old Riggs Mill Road.

Protective Real Estate Investments, Inc. developer of Chatham Place Two Phase IX is requesting a county streetlight tax district. Protective Real Estate Investments proposes to include 26 lots at or near Archer Way. (Take Highway 67 south to Burkhalter Rd. make a left at the stop light travel past Cawana Road and make your next right on Chatham place drive approx. .75 miles make a right on Providence and then a left on Archer way.)

Marvin Deal Jr. submitted an application for a Conditional Use. The Conditional Use proposed is for the use of the existing facility for both private and public functions. The property is located on Kennedy Pond Road. (Take highway 301 south to highway 46. Turn right on highway 46 continue to sinkhole road and make a right. Turn right on Kennedy Pond Road.)

P&Z and Staff both recommended approval with conditions.

Deal was present to advocate for his application.
A neighbor was present to speak against the project due to more than 100 cars passing his home to get to the property.

Commissioner Walter Gibson made a motion to approve the application, it was seconded and the application was approved unanimously.

Levy Lowery submitted an application to rezone 13.52 acres from AG-5 to R-80 to divide the property into 3 residential lots approximately 4.5 acres each. The property is located on Mill Creek Road. (Take highway 24 for 3.25 miles turn left onto Franklin Road. Travel 1.5 miles, turn right onto Mill Creek Road. Travel 1 mile to property)

P&Z recommended approval.

Commissioner Jappy Stringer made a motion to approve the application, which was seconded, and approved unanimously.

The Bulloch County Planning and Development Department proposes to amend the Zoning Ordinance of Bulloch County to include definitions and regulations related to commercial cryptocurrency mining operations.
View the proposed definitions and regulations here, which were proposed due to the fact that Bulloch County’s current code made no reference to the business type, which continue to increase in popularity.

Commissioners opted to take no action and will consider again with consideration of stakeholder submissions of word choice.

Shari Barr – City Councilwoman – 3 things to discuss: City created a new ‘Greener Boro Commission’; she congratulated the county on a successful ArtsFest, and she recommended a recreational seminar coming up later in May.

  3. Motion to Approve the Lowest Quote from Augusta Chillers in the amount of $54,300.00 to replace 20 ton and 7.5 ton HVAC units at Judicial Annex
  4. Motion to renew annual service contract with Bulloch Solutions for countywide network and communication system.
  5. Motion to approve Quit Claim Deed from Bulloch County to First Presbyterian Church.
    • According to staff, there appears to be an old abandoned road right-of-way running through the property of the First Presbyterian Church. Attorney Sam Broucek discovered this during title work for a loan closing for the church and needs a quitclaim deed from Bulloch County to satisfy the title insurance company as to marketable title for the property. The abandoned right-of-way may have been for the original location of Georgia Avenue, which has been reconfigured to its current location. In any event, the abandoned right-of-way serves no present purpose for the County and negatively impacts the church’s property. Approval of the quitclaim deed is recommended by staff.

New Business

  • Discussion and/or Action regarding bids received for Horizontal Mowing.
    • County staff reported that the bids came in much higher than the county planned for or budgeted for and therefore, suggested that commissioners reject all bids and go back through with a more narrowly focused RFP. Staff said considerable savings would be seen by re-doing the process.
    • A motion was made by Commissioner Mosley to reject all bids and it passed unanimously.
  • Motion to approve Corbett Enterprises for one cycle of horizontal cutting to address issues in the interim. They are the only contractor capable of staging up to begin work within two weeks.
    • The motion was approved unanimously.
